Houston Luxury Lighting

- Payments clause –
- A 50% down payment is required to schedule your installation or before any materials are ordered for the project. Final payment is due upon completion of the services provided that day.
- All payments may be accepted in the form of check, debit/credit card, cashier’s check, or money order made out to Houston Luxury Lighting, LLC.
- Late Payment clause –
- A 6% fee will be applied per day for interest and penalties on any outstanding balance for services provided not yet paid for. This will fall under any work being approved to be performed via written paper or electronic contract, email, text received from client and or representative of client, or verbal confirmation which is recorded through our phone systems.
- Late payments will only be accepted in cashier’s check or money order made out to Houston Luxury Lighting, LLC.
- Repossession clause –
- Houston Luxury Lighting reserves the right given by customer signature of this or any official Houston Luxury Lighting document or deposit made towards work being provided to repossess installed systems due to lack of payment after 5 days of completed contract work.
- If repossession occurs, you are forfeiting your entire deposit which will be applied towards labor to install your system. Note that 50% of your total bill is labor, and 50% of your total bill is materials.
- If repossession occurs, your account will be charged an automatic $500 fee. At this point your entire final payment plus accrued interest plus the $500 repossession fee will need to be paid in order to have your system re-installed. These payments can only be made in cashier’s check or money order made out to Houston Luxury Lighting LLC.
- Damages to property clause –
- If damages are caused to your property, a written email must be provided to Houston Luxury Lighting requesting repair of damages caused by Houston Luxury Lighting describing damages including pictures and date. Houston Luxury Lighting will take full responsibility and fix said damages at house, or hire a professional company to do said repairs.
- If damage claims are made, they must be made within 3 days of your completed install, or you forfeit your legal right to take actions against Houston Luxury Lighting. Additionally, if you hire another company to fix damages without written consent of the owner of Houston Luxury Lighting, then you fully release Houston Luxury Lighting from all responsibility and you have no legal recourse against Houston Luxury Lighting.
- If damages are caused by staff of Houston Luxury Lighting within the 3-day allowed period, your final bill still will need to be paid for Houston Luxury Lighting to begin repairs on your damages.
- Maintenance clause –
- If your installation has been completed, and you require a simple maintenance or adjustment on the installed system, the final payment must be received before we will schedule the maintenance or adjustment to be completed.
- Manufacturer requires to have at least one basic maintenance done each year after installation to keep the manufacturer warranty intact, Manufacturer requires a specific maintenance to be performed by manufacturer certified company in order to assure system is in top working order to guarantee the 20 year warranty being provided. Our systems come with manufacturer warranties (Not warranty from Houston Luxury Lighting)
- These Warranty Terms & Conditions stipulate that regular maintenance/service must be performed by the original installing Garden Light LED authorized dealer and within a reasonable timeframe depending on the environment, minimum bi-annually, e.g.: lines tested for shorts/breaks and proper burial; connections verified; fixtures/transformers cleared of buildup/debris that cause over-heating;
lenses cleaned; submersible fixtures freed of buildup such as clams/barnacles; submerged lines checked for shorts/breaks and proper protection; submerged connections verified etc. - The GARDEN LIGHT LED 20 Year Limited Warranty only applies when all lighting system components (including corrosion free wire, drum connectors, transformers etc.) are GARDEN LIGHT LED components, installed by a GARDEN LIGHT LED authorized dealer. Substituting another GARDEN LIGHT LED dealer at a later time will render the warranty void. Transformers must be GARDEN LIGHT LED brand with the A81 LED Protection Kit installed.
- Warranty excludes damage caused by any of the below specified reasons;
- Abuse, accident, mishandling, or Improper installation (does not meet NEC Codes)
- Failure to adhere to the provided operating instructions.
- Exposure to chemicals such as Chlorine, Pesticides, Fertilizer, or Salt Water (excluding water in the case of waterproof products).
- Servicing or modifications of the Product other than by GARDEN LIGHT LED, or their authorized service agents.
- Improper, or Negligence in the maintenance/service.
- Acts of God or Natural Phenomena (e.g. Insects, Fire, Tornado, Hurricane, Lightning Strike, etc).
- Transient Electrical Surge or High Energy Pulse e.g., lightning, construction equipment, Power Line transformer.
- Houston Luxury Lighting has set up affordable service packages for maintenance based on the number of fixtures. If a service package is not purchased for the annual basic maintenance, Houston Luxury Lighting will charge a minimum of $99.00 trip fee to your address.
- Any issue that arises from a line being cut or damaged or anyone that has tried to fix the issue at hand, the warranty is null and void and a $99 trip fee will be accessed. Houston Luxury Lighting reserves the right to cancel your warranties if you or any other person or non-manufactured certified company services the installed system.
- Anything that is out of the scope that was preformed, there will be a $99 trip charge.
- No trip charge for up to one year after installation.
- General Maintenance Will Include –
- Washing all fixtures
- Refinishing of fixtures due to hard water from sprinkler systems Etc.
- Burying exposed wires
- Re-positioning of fixtures due to plant growth
- Making system look as new as possible
- Preventative maintenance
- Adjustment of timers if requested by homeowner
- Cancellation of contract clause –
- If you cancel your contract at any time before the day of installation, you will forfeit your deposit. If no deposit was obtained, then you will owe 50% of contracted price.
- If your contract has been signed and the materials have been ordered, then you will owe 50% of contracted price for materials and restock fees.
- All cancellations must be in writing only. We will only accept cancellation in writing no later than 5 days before scheduled installation.
- Legal action Clause –
- If you decide to take legal action in any way for any reason against Houston Luxury Lighting, mediation must be taken first before any other legal action is taken. If mediation cannot come to an agreement, then further legal action can be taken.
- Location of legal jurisdiction for any claim or mediation is to take place in Navasota, Texas.
- Whoever is ruled against in any legal proceeding or mediation is responsible for all court costs and legal fees.
